1. Acceptance of Terms

By accessing or using GymOS, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our platform. These terms apply to all users, including gym owners, employees, and any other users of the platform.

2. Description of Service

GymOS is a gym operations and management platform that provides tools for managing members, memberships, employees, payroll, revenue tracking, and related gym operations. We provide access to these tools on a subscription basis, with a free tier available for basic operations.

3. Account Registration

To use GymOS, your gym must be onboarded by our team. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information during onboarding and keep it up to date. You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree to use GymOS only for lawful purposes related to gym operations management. You must not use the platform to store false or misleading information, attempt to gain unauthorized access to any part of the system, disrupt or interfere with the platform's operation, or share your account credentials with individuals outside your gym.

5. Data and Privacy

You are responsible for the data you enter into GymOS, including member information and financial records. You must have appropriate consent from individuals whose data you add to the platform. Our Privacy Policy explains how we collect, store, and protect your data. You retain ownership of your gym's data.

6. Payment and Subscriptions

GymOS offers a free tier with basic features. Business plan pricing is based on your gym's size and requirements, discussed during onboarding. Payment terms will be agreed upon before upgrading to a paid plan. We reserve the right to modify pricing with reasonable notice.

7. Service Availability

We aim to provide reliable and continuous access to GymOS. However, we do not guarantee 100% uptime. Scheduled maintenance, technical issues, or circumstances beyond our control may occasionally affect availability. We will make reasonable efforts to minimize downtime and provide advance notice of planned maintenance.

8. Limitation of Liability

GymOS is provided as-is. To the extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the platform. Our total liability for any claim shall not exceed the amount paid by you to GymOS in the three months preceding the claim.

9. Termination

Either party may terminate the use of GymOS with reasonable notice. Upon termination, you may request an export of your gym's data within 30 days. We reserve the right to suspend access in cases of violation of these terms, non-payment, or conduct that may harm other users or the platform.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or through the platform. Continued use of GymOS after changes take effect constitutes acceptance of the updated terms.

11. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these terms or your use of GymOS shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India.
